It depends on the contract, but back then it was not uncommon for bands to sign away the rights everything that was recorded during the period that they were under contract.
As RD says, they'd still need to prove it was recorded in the period, but as Jon still has a working relationship with the label, I doubt he'd want to risk upsetting them.
