I don't think so, it's not like it's illegal to own the recordings. If you say "he claimed he had previously unreleased songs by the bands and was selling them", you're not lying, and I doubt anybody would be like BUT YOU'RE BUYING SOMETHING ILLEGAL. But I'm not familiar with US law.
