Rules regarding the mechanical and intellectual copyright.

You can't just take someones song and make money off it yourself. The drummer in my band is in a van halen tribute band and had their lawyer send them a letter saying they'd be going to court if they kept sellign CD's they'd done of van halen tunes.

The only "rule" that you don't really need permission for is if you're not going to make any money off of it.

From the PRS and MCPS site

What are the restricted acts?
These are:

to copy the work

to issue copies of the work to the public

to rent or lend the work to the public

to perform, show or play the work in public

to communicate the work to the public*

to make an adaptation of the work or do any of the above in relation to an adaptation

*includes broadcasting, broadcasting on demand and use of music on the Internet
interactive services, including satellite and cable transmissions.

No-one can authorise any of the above acts without the copyright owner’s permission.


Generally the author of a work (described in the Act as the ‘person who creates it’) is the first owner of any copyright in the work. However, since copyright is a form of property, the author can transfer the whole or part of his copyright in a work to another party (such as PRS or a publisher), so the author of the work is not necessarily the copyright owner


Because it's the PRS and the MCPS this covers doing it live as well as havign it on a recorded media.

as far as i know the ompa's said a while ago no permission is needed.

however, most artists call the one they cover and ask for permission but they don't have to!

ANd I really want to hear that cover...

Read what I posted above. this is from the UK (ie Rachel Stevens) appropriate performance and mechanical copyright societies site.

The exact same will be said on the ASCAP site.


problem being anyone who's going to sell a fair amount of records and make the publisher and artist a decent amount of money (which rachel stevens will probably do) will not be questioned by either of them.

There's plenty of stuff that officially should be done in the industry that isn't.

The story behind this is that Rachel Stevens was on CDUK (tv music chart show) and was asked which song she would like to cover , she said Prayer. So I wouldnt worry about it being in the charts anytime soon!!
