If one of them is not present the costumer should be able to get a refund as the given party is not able to live up to it's promise. Not sure the legal system would see it the same way. Even you felt the need to clarify "bon Jovi,as in the four official members". Legally Bon Jovi is Jon BonJovi, even if people have different feelings on the subject.
Just as a play with a famous actor in it if for some reason they don't perform in the show you see, there are no refunds.
As a side note Phil has been doing an amazing job. People should have been looking for refunds when Richie was so loaded on stage he was missing solo's and screwing up.
