Default Legality of Bootlegs

Okay, so I know record companies won't own the mechanical rights to bootlegs, unless they are of a commercially released concert, but do they own the publishing rights to bands' material, even in a live form, and are they fussed about enforcing this right?

Essentially, what I'm asking is are DimeADozen users about to get sued anytime soon? Have any been already? I know the chances are slim even if so, but is it worth sticking to offline trades?

And, whilst I'm thinking about it, what is Bon Jovi's taping/trading policy?
