I think this still goes back to the idea that there's a negotiation of some sort going on. And that the "he's welcome back anytime" is closely tied to "he's in the band until he says he's not." I think both refer to whatever "negotiations" may be going on, if that IS what is going on.
As several suggested earlier, if this is about a contractual issue, then there's no reason for Jon to change his stance. Someone said, "Jon hasn't moved the goalposts" (or words to that effect) so Richie can indeed come back any time he wants (and live by the terms of the contract) or
he is going to have to be the one to say he's not in the band anymore (i.e., "I hate my brother and I'm quitting the band" maybe?). Because (and I'm TOTALLY guessing here) IF Jon fired him, then wouldn't
Jon be the one breaking the contract?
But I think there's even more to a scenario like this than meets the eye. There still has to be a negotiable questions/issues up in the air, whether it is the "demands" that are being negotiated or something else, because otherwise it seems to me that it would just be:
Richie: I'm leaving.
Jon: OK - you're in breach of contract. I'll let the lawyers know.
If it was that cut and dried, wouldn't we have already heard that Richie was out and [insert name] was the new Bon Jovi guitarist?
