Can't really see how the defendants can argue their case, in the UK corporate manslughter has been on the statute books for several years and the EU have tightened up on Health and safety legislation.
however no one has yet been tried on this point of law in the uk ( a number of cases are pending the european courts of human rights but with a timescale of 7-8 years, a long way away)
