basic law of contract: if theres an offer and acceptance and everyone has capacity to contract then a contract exists

you try proving it. unless it's in writing it's very difficult to challenge.

so i take it u haven't actually studied any contract law then? i assumed that the person in question had signed to say the offer was accepted but i guess not.

selling of property requires the contract in writing. almost any other contract is totally valid whether it be written, spoken or implied.

contract law in scotland and england is pretty much identical the only major exception being that in England all parties must gain something from the contract whereas in scotland u don't.

you don't sign a contract when you've accepted an offer. contracts aren't signed until much further down the line. you take the seller's word for it.

once theres an offer and agreement there's a valid contract, signing an actual document simply gives solid proof but as i said, the seller can do that in this case cosd with property deeds the contract has to be written.
