ah, that makes more sence now....
It just seems stupid to me.... Why not kill them? If they're really bad, and given death, and then become religious, and repent, and become a model person, do they get to walk? no. So why should somebody who developes a mental illness not have to pay for a crime they did, even though they may be different now....
There's a good bit in Measure for Measure, where a criminal is about to be executed. He's drunk though, and refuses to be executed.... They bring him out, and the priest (well, Duke if you know the play) says he's in not fit state to die. So because he's in the right mind to die, they won't kill him... Maybe it's got something to do with that. They don't think as Christians they can send somebody off to the 'next life' if they're not menatlly prepaired for it, and if they're ill...
Easy solution, no capital punishement.... that solves the problem!!!!!
