Default Work Related Injuries

Hello there,

Basically, after a weeks holiday from work, I went back in on Monday. I went into our stockroom to get some stock. When I got inside I found that all the isles inbetween were blocked with other boxes of stock and it was extremely hard to get down the isles because it was so tight. All the Frames in the stockroom are pretty full, and at the moment with Christmas looming, we are getting up to two large deleveries each day. The stockrooms are pretty much bursting as they are but are only going to get worse. It is the same every year.

Anyway, I had to carry a box or two above my head to get the stock out the stockroom because I couldnt squeeze down the isles with the boxes, and as Im walking down the isle, I have knocked a Glass Chopping Board off on of the shelves above and behind my head, its fell down and crashed onto my foot, incidentally breaking one of my toes.

Currently, im finding it hard to walk on my left foot, and have been given Crutches by the hospital. It will take upto six weeks to fully heal, but wont be able to work for around two-three weeks.

I only work part time, but does anyone here know If I am entitled to loss of earnings seens how it was a injury sustained on works premises?

Do I stand a good chance, if I make a claim? I was wondering if anyone else has claimed for compensation for a situation similar to this in the workplace, or know anyone else in the same boat as myself?

I would like to make a claim, but do not want things to be akward in work, or face the sack, if I try to get money of them.

What do you guys think I should do?
Any help is appreciated.

Scots law and English law is fairly different but when we're talking about negligence here it's all basically the same.

Your work has "duty of care" to it's employees which is pretty self explanatory in that they've got to make sure employees are safe at work.

If the thing fell cos it was stacked up wrong or whatever then you might have a claim.

Get yourself down a lawyers for a free consultation. Not one of these things you see on the telly, a proper lawyer n see where they stand. It's pretty shitty of them not paying you when it was sustained on presmises and apart form that, you could get compensation as well for pain endured etc...

seriously go n see a lawyer.

N stick with the crtuches. i had a mate who seriously took a coupla pills n jumped out of his window. broke something or other in his foot n didnt bother with his crutches so now he walks like a ****in moron

As i am my own boss i just carry on but i find the strong pain killers are great!! i feel nothing at the moment , oh wait is that just the wine

In the States you would be entitled to Worker's Compensation. At my job you would be put on "light duty" in a position you could handle. If no such position existed, we would have to create a job for you to do until you were healed. Plus, all your medical expenses would be paid for as well.

I don't know about English law Kev, but I'm sorry to hear that you hurt yourself. Crutches are a pain in the a.. um armpit

Thanks for the advice people. I am going to go into work on Monday morning and see if they can offer me my loss of earnings, seens how I dont see why I should be out of pocket because they cant afford official stockroom assistants to come in once or twice a week to sort put the stockrooms and to prevent causing an injury. If the company connot guarentee I will be paid for these few weeks off while I am on crutches, then no-doubt I will be making a claim and taking them to court.
